Question Description

Decades have now passed since the bombing of the Murrah Federal Building in Oklahoma City by Timothy McVeigh in 1995 and the terrorist attacks on the World Trade Center and the Pentagon by al-Qaeda in 2001. Despite the significance of both of these domestic terrorism events, the War on Terror has almost exclusively focused on international terrorism.

Critics argue that the War on Terror needs to focus on more than just international terrorism, because domestic terrorism poses a greater threat in terms of lives and property loss than international terrorism.

Based on this debate, which terrorist threat is currently the greatest threat in the United States? Is it an international terrorist group, such as al-Qaeda, or domestic terrorist groups and their loose affiliates, such as Timothy McVeigh?

It is hard to say which type of terrorism, international or domestic, is more of a threat. I think they are both equal threats as either one can produce a significant amount of death, damage, and instill fear. I do think the scales are tipped to the side of international terrorism as far as the United States priorities lay. I think the federal government has recently noticed it too. Deputy Director Travers of the U.S. National Counterterrorism Center stated in a recent speech, “we are also seeing a growing threat of both right-wing and left-wing domestic terrorism” (Travers as cited in Andrews, 2019, p.3) During an interview with Chuck Todd (NBC, Meet the Press), when asked about domestic terrorism currently being a bigger threat than international terrorism, Kevin McAleenan, Acting United States Secretary of Homeland Security, responded that domestic terrorism absolutely is a larger threat and explained how the DHS supports that mission, but the Department of Justice is the lead agency for the issue. (National Broadcasting Company, 2019) The Department of Homeland Security (DHS) recently published its Strategic Framework for Countering Terrorism and Targeted Violence, within the document are several statements on the DHS’s acknowledgement of domestic terrorism is an emerging threat.

Since both domestic and international terror incidents have the potential to cause the same damage, the focus should be equal. However, I do believe that at times it may have a priority on either side and the U.S. should react accordingly. DHS’s Strategic Framework states that Domestic threat actors often plan and carry out their acts of violence alone and with little apparent warning, in ways that limit the effectiveness of traditional law enforcement investigation and disruption methods. (Department of Homeland Security, 2019, p.1) This is a serious problem for the government to overcome. I think the only way to combat this issue is to involve the community in a partnership with law enforcement to detect actors prior to them taking action. DHS’s Strategic Framework acknowledges that border security cannot stop violence originating inside America and prevention efforts must include “whole-of-society” partnerships. (Department of Homeland Security, 2019, p.6) The “Framework” document provides insight that citizens need to know how information they provide supports protection and prevention efforts. I agree with this thought process, as when people know how their efforts are helping they are more inclined to continue to help and when others see the positive effects of citizen involvement, they most likely be inclined to help law enforcement.

International and domestic terrorism both pose a significant threat to the security of the United States. However, there have been far more domestic terrorist incidents than international terrorist attacks on our country overall. Homegrown terrorism is our greatest threat due to the higher frequency of it. I think many people in the United States fear international terrorism over domestic terrorism because of the 9/11 attacks. International terrorism is certainly a significant threat to our country, but domestic terrorism is more commonly an issue. However, international terrorist attacks have the potential to be highly devastating, as we saw on 9/11/2001.

There are more homegrown terrorists in our country than terrorists with international affiliations. At the peak of the Islamic State’s reign, there were many ISIS “sympathizers” in our country in support of the terrorist group. Domestic terrorism is defined as victims within a country being targeted by a perpetrator with the same citizenship. The FBI uses the term Homegrown Violent Extremists (HVE’s) to describe individuals who are self-radicalized primarily in the U.S. with no direct connections with foreign terrorist organizations. The FBI is investigating reports of HVE’s in every state in America.

Project Assignment:

As a member of the Virtual Police Department’s Administrative Services Unit you have been called into a meeting with your supervisor, several other police commanders, and the Chief of the Virtual Police Department. This is what you are told by the head of the Criminal Intelligence Unit.

Several jurisdictions in the vicinity of Virtual have experiences “Flash Robs”. These are groups of teenagers and young adults, both men and women, who descend on a commercial store and, on a given signal, grab as much merchandise as they can carry and flee the store in mass. The size of the group and the quickness of their action made apprehension almost impossible for the overwhelmed store employees. Targeted stores range from sporting goods outlets, and electronic shops, to pharmacies and liquor stores. There is some evidence that the mob is organized by codes using social media. The Virtual Small Business Association is petitioning the Mayor for a plan to ensure these mobs to not attack the downtown business area. They are insisting on more police presence (particularly during peak business hours) and closer cooperation between the police and their own private security.

The Chief has decided to form a 8-unit task force. This operation will be a collaborative effort involving both the Virtual Police Department and other appropriate “partner” agencies within the criminal justice system. The Administrative Services Unit will draw up the proposal for the Chief to take to the Mayor. Your supervisor gives this assignment to you.

SCENARIO:

Judge James Shoreman is up for reelection in 2 months. He has a full docket on Monday morning. Two of the individuals on this docket are Thomas J. Catalano and Abdul Hussein Jabari.

Mr. Catalano has been charged with involuntary manslaughter. His prior record consists of breaking and entering, assault on a police officer, and possession of narcotics. Mr. Catalano has a “high-priced” lawyer with the discretionary funds for an additional investigation. Mr. Catalano has a wife and two children. He has been employed for 5 years for the local banking institution. Mr. Catalano has received a 10-year probation sentence with the stipulation that if he violates this probation, he will serve the remainder of the sentence in the state prison.

Mr. Jabari has been charged with the distribution of a controlled substance (prescription drugs). His prior record consists of possession of narcotics and falsification of identity. Mr. Jabari has a court-appointed lawyer who is on the pro bono list maintained by the judge. His funds are limited but the Muslim community has rallied to his financial aid, and there have been demonstrations at the courthouse. Mr. Jabari has a wife and three children. He has been employed for 8 years as the chief chef at a local restaurant. Mr. Jabari has received 7 years in the state prison, without the possibility of good time.

The judge’s reasoning for his decisions is based on the fact that one individual is wealthy, Mr. Catalano, and may have wealthy friends that contributed to the judge’s re-election campaign. The other individual is not wealthy and relies on the Muslim community for financial aid. If you want to play the race card, some people might say that the judge’s decision is based on Mr. Jabari being Muslim, and to give him probation or a lesser charge would lessen his chances of getting re-elected.

The judge would have a hard time supporting his decisions, in my opinion. How could a judge give probation to a suspect charged with involuntary manslaughter, (a felony in most states), and has a prior record consisting of breaking and entering, assault on a police officer, and possession of narcotics? The Muslim suspect receives seven years in prison for distribution of a controlled substance (prescription drugs). His prior record consists of non-violent crimes, but he still received a much harsher sentence. How can anyone with a little common sense, rule in this unfair manner and when both suspects committed felonies, and have very different records?

The judge showed bias with his decision making of these two cases. He showed bias when it came to the sentencing of these two men. The wealthier man received probation, and the blue-collar worker received seven years in prison for a less violent crime. The judge used a form of ‘cognitive bias,’ when he made his unorthodox decisions. ‘Belief bias,’ is described as “someone that is so sure about his own gut feeling that they ignore other facts or statistics” (Mester, 2017).

I don’t believe that the demonstration for Mr. Jabari had any effect on the judge’s decision to send him to prison. One would think that if support for Mr. Jabari were so prevalent, the judge would reevaluate his decision-making process.

The first case I found in which minorities were wrongly convicted and sentenced is ‘The Central Park Five.’ This case stems from five minority teenagers that were convicted of raping a white woman in Central Park in 1989. Their sentences ranged from six to thirteen years, but they were all exonerated in 2002 when a serial rapist confessed to the crime.

The Chief of Police and District Attorney were both pursued relentlessly by the public to find the criminal or criminals who committed this horrendous crime. The pressure from the public forced the top two law enforcement officials to arrest someone. The police arrested the five teens and used sleep deprivation, threats, and fear to coerce the five teens to confess to the rape and assault of the woman.

The second case that I found was based in my home state of Colorado. Defendant Ronald Higgs was tried and charged in 1978, with two counts of first-degree burglary,[1] two counts of first-degree sexual assault,[2] and one count of first-degree criminal trespass.

Mr. Higgs was ultimately acquitted of all charges when it was discovered that he was arrested under false pretenses. “Sandra Price, the complaining witness, initiated and maintained the criminal action against him without probable cause, and that she was motivated by malice” (Justia, 1978).

It was also discovered that two deputy sheriffs with the Douglas County Sheriff’s Department, and James R. Florey, Jr., Michael Miller, and James Peters, deputy district attorneys in the District Attorney’s Office for the Eighteenth Judicial District were involved in the cover-up of arresting and charging the wrong man. The prosecution knowingly prepared false affidavits and misleading affidavits with an order for nontestimonial identification evidence, an arrest warrant for Higgs, and a search warrant for the search of his home.

U1CD Impact of Diversity in the Criminal Justice System

Question Description

Using 100 words or more, please respond to the following post concerning diversity in the criminal justice system:

Here you see that Mr. Catlano and Mr. Jabari are two men that commit crimes, and both had prior. But Mr. Catlano has more things on his record, but Mr. Jabari had one prior and that was for drugs. As you can see that Mr. Catlano got less time than Mr. Jabari.

In both cases, it seems that the judge play race between Mr. Catlano and Mr. Jabari. When it comes to race it a great deal of controversy.” (MUSE). Mr. Catalano has a prior record like breaking and entering, done assault on a police officer, along with narcotics and he on 10-year probation, but Mr. Jabari he received seven years without the possibility of a good time. In this case, it did not tell everything that happens in court but as you can see Mr. Jabari got time and Mr. Catlano, he received probation. “Race is one of the most social problems in the United States.” (MUSW).

“Investigating difference, it helps people to understand something to be seen as a resource, or to be celebrated.” (Ebooksdvd). Race has always been a part of the United States, why because people don’t like a person’s skin color. If you watch the news you will see that a person of color as been kill by another race. The judge did not care if Mr. Jabari had a family or a job, he just saw skin color, therefore so many of the majority are in prison because people only see skin color. “When it comes to the criminal justice system the United States has the largest in the work where men of color or incarcerated in federal, state, that are in prison or in jail. There are about 6.7 million people of color that more in prison than any other race (Prisonpolicy.org).”

I don’t think the judge can support his decision because he must explain why he sent one man with lessor crime to prison, but don’t send the other one to why he prisons that have done more crimes, there is no way he can explain how he can explain this. The judge did show bias and that was racial bias or implicit bias. “The judge disfavoring black defendants that are tainted with racial bias.” (Weeks. V. (2018).

I would say that it not fair sentencing because they both should go to prison or got probation it not fair to send one to prison and not the other one.” (Weeks V. (2018). Everyone should get fair sentences instead of some getting unfairly deal.

This case happens in “Florida where a judge gave a black man 26 years in prison and gave the white man two years for the same crimes (snopes.com).” These two men were in the same courtroom, had the same crime, and they both pleaded guilty to the same judge, and same date. A white man robbed three men in a drug deal, and he was 19 years old, by the name of Legeitner, the other man is a black man he robbed a pizza hut and a gas station, and he is 21 years old and his name is Mr. Lloyd. “Both men pleaded no contest on two counts of armed robbery.” (snopes.com). The only thing they had on their record is a misdemeanor on their record. Legleitner is out prison and during what he wants, but Mr. Lloyd he is 47 years old when he is released in 2034. This sentence was not fair, but it was biased because one man was white and the other was black, so there was no cause for this. “The biggest crime in the United States criminal justice system is that race is the biggest problem were African Americans are targeted and punished more than with people.” (Weeks, V. (2018).

This is a true story that happens in Nevada with my son. A black man was sentenced to thirty years to life for firing a gun in a building. Whereas a white man was sentenced to three years for the same crime. Mr. White was a 24 years old black man who was having a party he was showing his gun to his friend when the gun went off. Someone calls the police and they tool Mr. White to jail. About two years later a white man named Mr. Morales he was shooting his gun in the house for fun, and he was shooting around children, but when Mr. White when he went to court, he got a lot of time, but when the white man Mr. Morales went to court he got three years so Mr. White is still fighting to get out of prison, but Mr. Morales has been out for a while.

I believe in Competency 1-5 I have gained a better understanding of the concepts, skills, and insights when it pertains to criminal justice rights and wrong ways of completing tasks and assignments. The most understandable concept is that no matter which type of field whether it’s within criminal justice or another field there will be rights and wrongs of how things are to be done. It will depend on the thinking and working progress of individuals. The most understandable skill would include communication if there is no communication within groups or members of a community then many individuals will tend to find justice on their own no matter if the officials agree or disagree with the result. The most understandable insight is that members and officials should work together no matter the similarities and differences of what is important such as safety and protection.

To future my career I would broaden and choose certain concepts, and skills that will further my career such as make sure that every individual has a say on matter or issues that can make the community better.

It hasn’t changed much at the beginning of the course I was able to understand from a perspective that criminal justice is not only a field of study. It was more that those who were in the field needed to get a wider perspective and narrow their choices down. In which everything and anything is and can be a two-way street, and that a result can have a more than one result. Although the course is coming to an end, it has given me a more narrowed path that choosing a career should not only be life changing, and which it should give others the chance to express themselves as a person that everyone can work together.

  • I think the most important thing I learned throughout this course was the fact that the depth of what it takes to be a good leader is extremely deep. It’s not just as simple as telling people what to do. It takes much more than that – ethics, conflict resolution techniques, professional communication skills, etc. There is a finesse to being a good leader and not everyone has that. You have to be driven, have good people skills, and be willing to learn and do what it takes to achieve your goals. Research is required to evaluate your successes and find solutions to your problems.

Explain how you will use those concepts, skills, or insights in your current or future career.

  • The skills I have learned throughout this course will be extremely beneficial for me as a juvenile rehabilitation counselor. I will be instilling leadership skills in juvenile delinquents in order to ensure they live a crime free life. I will be able to teach juvenile delinquents conflict resolution techniques and communication skills that will help in all facets of their lives. I will be counseling them in life in general, so I will need as much help as I can get with learning leadership skills. I can teach these kids good ethics and morals that will help in all aspects of life as well. I can teach them research skills that will help them in school.

Express how the capstone course has changed your perspectives in a criminal justice career context.

  • This course has shown me how much work it takes to be a leader. I have a lot more respect for leaders I have encountered. It has shown me how dedicated a leader has to be to be successful. It has shown me that a leaders role is important to any company or organization, especially in a criminal justice context. This course has also shown me how versatile and flexible a leader must be. They must be ready for anything and be open to anything. Like I said earlier, being a leader is not as simple as telling people what to do. There is a lot more to being a leader than most people realize.

John Alien, a native and citizen of England, entered the U.S. under a non-immigrant visa in April 2004. During his stay in the U.S. he fell in love with a U.S. Citizen, married, and adjusted his status to a Lawful Permanent Resident. He became an LPR in April 2006. He has two children (ages 3 and 5) from the marriage and owns a beautiful home in Florida. He is an IT specialist for a very large military defense contact corporation and earns approximately $130,000 per year. He has a growing 401(k) and excellent health insurance for his family through his job. With his robust salary, his wife is able to stay at home and raise their two children. He has an impeccable reputation in the community and is active in his local church and his children’s school activities. In May 2016, John was arrested for possession of cocaine. He has no prior criminal history. He pleaded guilty to the crime and was placed in immigration removal proceedings for the drug conviction.

The Notice to Appear charges John with violating §237(a)(2)(B)(i) of the INA, as having been convicted of a drug offense. You are the immigration judge presiding over his removal hearing.

-Can John be placed in removal proceedings? Will you as a judge sustain the charge of removabilty?

Teddy lives in Los Angeles, having arrived through crossing the Mexican border unlawfully 10 months ago. Teddy mostly gets by doing odd jobs and whatever he can do to make some cash. He would like to obtain work authorization so he can get a steady job and earn some more money, afford a place to live, and improve his overall standard of living. His friend, who has a work permit and a good job, tells Teddy he got his work permit after he was granted asylum in the U.S. Interested in obtaining asylum for himself, Teddy shows up at your law office asking what he has to do to get asylum.

-What specifically would you tell Teddy regarding what he needs to show to obtain asylum?

After your explanation, Teddy says he’s not sure he would qualify, but that he’s a “great storyteller” and since there are no strict documentary requirements for asylum, he’s sure he could convince the asylum office to grant his case. Teddy asks you to assist him in preparing his application and prepping for his asylum interview.

-How should you respond to Teddy? Will you assist him? What additional questions would you ask, or additional information would you gather.

After you speak more with Teddy, he asks your advice on what could happen to him if he were to make up a false narrative in an attempt to obtain asylum.

Bernard is a convicted felony drug trafficker who was deported from the U.S. three years ago to his native country. Three months ago, Bernard reentered the U.S. without authorization and has been living under an assumed identity. Bernard has no legal immigration status in the U.S. He has also resumed his previous drug trafficking activities, managing a large-scale illegal drug distribution operation in the New York City metro area. ICE Enforcement and Removal Operations (ERO) received a tip from an informant that Bernard is back and up to his old tricks, but he’s now going by the name “Ricky.” ERO officers conducted an investigation, including surveillance operations and have concluded Ricky is really Bernard. ERO officers now come to you, an ICE attorney, asking for advice on the best legal course of action to remove Bernard, AKA Ricky once again.

What are the options for ERO to remove Bernard, AKA Ricky? Please explain, in detail, and discuss all possible options.
